Investment Control: Screening Regulation (EU) 2019/452

On March 19, 2019, the European Union adopted a regulation establishing a framework for the screening of foreign direct investment in the Union, Screening Regulation (EU) 2019/452. The purpose of the regulation is to establish a comprehensive framework for the screening of such investments for reasons of security and public policy.

The regulation will apply from 11 October 2020.

Investment control in Germany is regulated in §§ 55 ff. Foreign Trade and Payments Ordinance (AWV) and is extended by the Screening Ordinance.
