Recast European Dual-Use Regulation

The Council of the European Union and the European Parliament agreed on a new version of the Dual-Use Regulation on November 9, 2020. This will replace the previous Dual-Use Regulation No. 428/2009. The recast is expected in mid-2021, once the European Parliament has given its consent.

Regarding the new regulation, BAFA states in its communication of November 18, 20202:

„Core elements of the agreement are new, stricter control rules for exports of certain interception and surveillance technology, deeper cooperation among member states through new coordination mechanisms in this area, the introduction of new General Licenses, harmonization of control rules for technical assistance at the EU level, better enforceability of controls through increased cooperation between licensing and customs authorities at the EU level, and more transparency in the EU Commission’s annual report while safeguarding trade and business secrets.“
